LEXINGTON, Ky. (WKYT) – Members of the Chevy Chase neighborhood have filed an appeal in Fayette Circuit Court seeking to overturn a conditional use permit issued for an inpatient mental health facility.
The Lexington-Fayette Urban County Board of Adjustment approved a conditional use permit, or CUP, for a facility on Duke Road. The complaint describes the permitted use as a “rehabilitation home.”
Many Chevy Chase neighbors have pushed back against the development, citing concerns that the facility could become a substance use treatment center.
ZLD Partners, the developers behind the facility, have said that while the company’s operating partner offers substance use treatment, the Duke Road location would focus on mental health.
The complaint filed by Chevy Chase community members alleges that the board’s decision to grant the CUP was unlawful, violating Kentucky statutory laws and Lexington zoning laws.
The complaint also said the board’s decision was arbitrary and capricious, as well as procedurally improper.
Some other concerns outlined in the complaint included the safety of children in the neighborhood and nearby schools and the board’s interpretation of certain zoning ordinances.
