About 2½ months after a judge ordered his commitment to Oregon State Hospital, a man charged with murder has been declared fit to proceed in court.

Joshua Margarito Saldivar, 38, has pleaded not guilty to a charge of second-degree murder after a Dec. 2, 2025, assault in downtown Eugene. Douglas Eugene Beinhauer, 42, died more than a week after police say Saldivar attacked him.

Lane County Circuit Judge Curtis Conover issued the Tuesday, June 16, order after reviewing an Oregon State Hospital report about Saldivar. 

The order means the murder case is now active, but the next proceedings have yet to be scheduled.

Lane County Circuit Judge Michelle Bassi issued the commitment order April 2, citing Saldivar’s “acuity of symptoms” and a recommendation from Lane County Behavioral Health that “appropriate community restoration services are not present and available in the community.”

Bassi acted after Saldivar’s defense attorney in March had requested the commitment following a psychological evaluation of Saldivar.

Eugene police say the fatal assault took place at about 10 p.m. Dec. 2, near the junction of Oak and Broadway alleys, behind a business on the 900 block of Willamette Street, according to a search-and-seizure affidavit filed in Lane County Circuit Court.

Also moving forward are proceedings in separate Lane County Circuit Court cases in which Saldivar has pleaded not guilty to charges of first-degree burglary, second-degree theft and disorderly conduct, among other charges.
